The Fourth Instruction Court of the National District decided to declare the accusation presented by the Public Ministry against the brothers Ana Linda Fernández de Paola and Emir José Fernández de Paola inadmissible. The resolution occurs within the framework of the Calamar case, a process investigated by the Specialized Prosecution Office for the Persecution of Administrative Corruption (Pepca) and which included the brothers among the accused from the initial stage.
Reason for Inadmissibility
According to the original accusation, the Public Ministry alleges that Ana Linda and Emir Fernández de Paola would be successors of Alessandro de Paola and that they would have employed false documentation to claim and receive payments from the State related to expropriated lands. In addition, they are charged with crimes of forgery and use of documents, association of wrongdoers, fraud against the State, and money laundering.
Separate Process and Judicial Decision
The brothers had been subject to a separate process from the rest of the accused in the Operation Calamar, as their files were separated and known independently. In the subsequent stage, the Public Ministry requested the opening of a trial against them and other defendants.
With the declaration of inadmissibility, the court emphasizes that the decision does not equate to an acquittal on the merits of the charges, but simply denies the admissibility of the accusation. The lack of admission is maintained until the ruling is known in its entirety.
